Capacity to Consent

Capacity to consent concerns whether a person can understand, retain, weigh and communicate a decision about the proposed intervention in the relevant circumstances.

What Capacity to Consent means in a Turkish medical case

The assessment is decision-specific and time-specific. It considers the information provided, communication support, effects of illness or medication and the person's actual reasoning.

A diagnosis, age or disability does not automatically establish incapacity. Equally, a signature does not prove capacity where material concerns existed.
